Press release on issuance of Circular No. 22/2021/TT-NHNN
Hanoi, December 29, 2021 – The Governor of the State Bank of Vietnam (SBV) has issued Circular No. 22/2021/TT-NHNN replacing Circular No. 43/2011/TT-NHNN dated December 20, 2011 stipulating the retention periods applied to the dossiers and documents archived within the banking industry.
The Circular has been issued in order to update the new regulations of a number of legal documents, such as: the Law of Archives (2011), Decree No. 01/2013/ND-CP, Decree No. 174/2016/ND-CP and other relevant legal documents; supplementing new dossiers and documents according to the functions and duties of the various entities, as well as dossiers and documents arising in reality (for instance: the category of documents on the banking specialized operations: domestic money market and gold market operations, State foreign exchange reserve and reserve requirement operations; documents on enterprise management; documents on monetary and financial stability; documents on banking and financial education; specific dossiers and documents on the protection of State secrets; judicial expertise in the field of currencies and banking; the issuance and the vault; the SBV communications, and the SBV's administrative procedures, etc.), in order to facilitate the assessment of the documents’ values, and the identification of the retention periods for the documents; improving the efficiency in the use and exploitation of the archived documents, as well as the destruction of expired documents by the SBV.
The new Circular is composed of eight (08) Articles, specifically as follows:

Article 5: Identification of the retention periods applied to different dossiers and documents

- The Table of retention periods applied to different dossiers and documents is composed of twenty-seven (27) categories of documents.
The Circular will take effect from February 15, 2022.
